Prior to obtaining Social Security benefits, the Social Security Administration needs to evaluate your disability and determine eligibility. A Los Angeles Social Security Disability attorney is equipped with the knowledge and experience to handle your disability claims. Every three or seven years SSA will conduct a continuing disability review and assess the state of your impairment. Benefits will be reevaluated if your impairment has improved or you have begun to work. Several impairments that have a low probability in improving will have longer time in between reviews and the reviews will be faster. Disability EValuation The Social Security Administration has compiled a disability evaluation for physicians and healthcare providers to have a guide on what is considered a disability and the programs available. The guide explains the program and how it works as well as information that health professionals will need to provide for a disability claim. Disability benefits are determined Social Security Administration field offices. When a claimant files an application, the field office representative will need information about the impairment and medical treatment. Once information has been verified the field office will send the case to the Disability Determination Services office. They will evaluate the claimant's disability and come to an initial disability determination and send it back to the SSA field office. Part A: Adult Impairment Listings The SSA has compiled a list of impairments they have deemed severe enough to prevent any gainful activity. The majority of these impairments are permanent or will result in death. Others are expected to last for at minimum 12 continuous months. There are 14 impairment categories with two added this year. The two new categories added are mental disorders and immune system disorders. Examples of the other categories include skin disorders, neurological disorders and hematological disorders. Adult listing of impairments are sometimes used to determine eligibility of children under the age of a18 if the impairment has the same effect on adults and children. Part B: Childhood Impairment Listings Childhood impairments will be evaluated using part B first and if the medical criteria does not apply Part A will then be used. Childhood impairments also have 14 categories including the new immune system and mental disorders categories. Even though many of the impairment are similar to the adult listings there are differences like with low birth weight and failure to thrive. This would be an example of a childhood impairment that does not apply to adult impairment listings. Social Security Disability Benefits Attorney California Social Security Disability benefits attorneys will evaluate your case and with their knowledge of the criteria be able to give you a realistic expectation. They can then file your claim and provide you with information on the next steps to take. Many disability cases having an SSDI attorney behind higher improves your chances of receiving benefits. This also takes some of the burden and stress of trying to understand all of the paperwork and process for benefits. |
